Maintenance surveys of racking / shelving installations is a much neglected area but one that can have serious consequences not only for those whom may be injured but also for those who are responsible for equipment under their control. The following text is a summary of comments taken from the health and safety act documents.

Section 33 of the Health and Safety Act 1974 identifies 16 offences for which directors or managers of a company may be prosecuted. The lesser of these offences carry a maximum fine of £2000.00. The most serious offences which refer to death or serious injury due to failure to discharge a duty to which they are subjected to by virtue of sections 2 to 6 of the act carry a maximum penalty of six months imprisonment and a £20,000.00 fine on summary conviction. Or conviction on indictment (conviction after trail by jury) this can be increased to a maximum of two years imprisonment and a fine of an unspecified amount.
